Your Permaglass Warranty

General

This limited warranty is extended to the original purchaser of PERMAGLASS WINDOW CORPORATION (“PERMAGLASS”) window and door products and is not transferable or assignable. Products are warranted to be free from defects in manufacturing, workmanship and materials for the periods stated herein. Labor will be provided for a period of two years from the date of original purchase. After that time, warranted parts will be provided and made available at the dealer closest to you.

Specific coverage and exclusions are listed below.

Insulating Glass

PERMAGLASS warrants for a period of 10 years from the date of original purchase that, if under normal conditions and usage, material obstruction of vision resulting from film formation or dust collection between the interior glass surfaces caused by seal failure of the insulating glass unit should occur, a replacement unit will be made available at no cost.

Fiberglass Components

PERMAGLASS warrants for a period of 20 years from the date of original purchase that, any fiberglass components will not degrade, bow or twist.

Paint

PERMAGLASS warrants for a period of 5 years from the date of original purchase that the factory applied surface of the fiberglass components will be free of blisters or chips and will maintain its original color.

Other Components

Other components will be governed by the specific warranties provided by the component manufacturer.

Claims Procedure

Any claims under this warranty should be submitted to the authorized dealer who supplied your products.

PERMAGLASS reserves the right for final approval of any claim and may require visual inspection. If after inspection the product is determined not to be defective, the purchaser will be charged for any expenses incurred.

Warranty Conditions

PERMAGLASS may deny warranty coverage if it determines that the defect is contributed to or caused by the purchaser's failure to maintain the products as follows:

Inspect and lubricate mechanism and weatherseal with a silicone lubricant annually.

Inspect and repair caulking and sealed joints annually.

Wash fiberglass components and paint surfaces annually with a mild, non-abrasive soap or cleaner (example: dishwashing soap).

Exclusions and Limitations

PERMAGLASS may deny warranty coverage if it determines that the defect is contributed to or caused by, or the defect consists of, any of the following:

PERMAGLASS expressly excludes and disclaims all express or implied conditions, representations and warranties including, without limitation, any implied warranties or conditions of merchantability or fitness for a particular purpose, to the extent allowable by law.

In no event is PERMAGLASS liable for any direct, special, indirect, consequential, incidental, or punitive damages however caused, whether in contract, tort, negligence, strict liability, operation of law or otherwise, even if we have been advised of the possibility of such damages. PERMAGLASS's total liability shall in no event exceed the amount paid by the purchaser for the product in question.

The purchaser acknowledges that PERMAGLASS has set its prices and sold the products to the purchaser in reliance on the limitations of liability and disclaimers of warranties and damages set forth herein and that the same form a fundamental and essential basis of the bargain between the parties. They shall apply even if the contract between the purchaser and PERMAGLASS is found to have failed in its fundamental or essential purpose or has been fundamentally breached.

No person, including any agent, employee, dealer or distributor is authorized to make any other representation or warranty concerning these products. This warranty is not a warranty of future performance but only a warranty to repair, replace or refund.
